A local court in Srinagar Thursday directed the Senior Superintendent of Police (SSP) Srinagar to register an FIR against its officer accused of acting “beyond the powers” in connection with the killing of a youth in Tengpora area of the city on July 10.
The Chief Judicial Magistrate Srinagar Masrat Shaheen, according to news agency CNS, while issuing the order for registering an FIR against Dy SP also directed the SSP Srinagar to submit the FIR copy before the court within 24 hours.
Earlier, the Chief Prosecuting Officer Khalid raised a contention that an FIR has already been lodged in the case. However, Advocate Zahoor Ahmed Bhat representing the petitioner said that police have lodged an FIR against the alleged stone-pelters and not against the erring police officer accused of killing an innocent youth in the premises of his house at Tengpora Batamaloo.
The CJM while rejecting the plea of CPO directed the SSP Srinagar to lodge an FIR against the erring police officer and submit the copy of that FIR before the court within 24 hours.
The CJM further directed that SSP should personally appear before the court in case he fails to register an FIR.
Pertinently, the petitioner Shabir Ahmed Mir a resident of Tengpora in his petition while seeking the registration of an FIR against the Dy SP had claimed that his son Shabir Ahmed Mir was killed by police officer in cold blood in the lawns of his house on July 10 this month.
The applicant had submitted that on July 10 at 6.45 PM when they were watching television, a police party headed by Dy SP barged into their house and started smashing windowpanes and doors of the house.
The wife of the applicant tried to stop the said police officer, however, he physically assaulted her.
“The son (Shabir Ahmed Mir) could not tolerate the thrashing of his mother and tried to rescue her from the clutches of the police officer. The Police officer took out his pistol and fired two shots at him resulting in his on spot death,” the court said while reproducing the excerpts from the application made by father of the deceased.
The applicant has further submitted that the said Dy SP took law in his own hands and killed his son in “cold blood” without any “reason and rhyme”.
He also submitted that he filed an application with the SHO Batamaloo, however, he refused to lodge an FIR against the accused Dy SP.
