Important to understand criminal justice system of other countries: IGP Kashmir

Zonal Police headquarters Kashmir in collaboration with Indian Institute of Public Administration, J&K Regional branch and Central University of Kashmir organized interaction cum presentation by two experts Dr. Robert Hanser and Dr. Diana Bruns on criminal justice system at ZPHQ.


On this occasion Prof. Mehraj-u-Din Vice Chancellor of Central University of Kashmir was the Chief Guest and Mohammad Shafi Khan, Principal District and sessions Judge Srinagar presided over the function.


Inspector General of Police, Kashmir Zone AG Mir said that in today’s world, countries have come closer to one another and the happenings in one part of the world have direct impact on another part of the world. “Likewise the criminal justice system of one place is impacting the criminal justice system of another place,” he said. He added that technical advances have made things somewhat complicated for criminal justice system, so it is imperative to understand the criminal justice system of other countries as well. In this context interaction like that of today has assumed significance.


The experts from United States held an interactive session with the participants which included DIG CKR S A Mujtaba, SSP Srinagar Amit Kumar , Joint Director Prosecution Mohammad Ashraf, Honorary secretary IIPA, Kashmir G M Andrabi, Chief Prosecuting Officers, Zonal SPs, SDPOs and Prosecuting officers. At the very outset JD Prosecution introduced the guests and highlighted the aim of the programme.


Dr. Robert D Hanser who is a senior professor in the criminal justice system and a coordinator of the criminal justice programme University of Louisiana USA in his presentation focused on civil/vicarious liability of Police personnel.


He gave a detailed description of his research in civil liabilities in criminal justice system in different parts of the world and interacted with the participants on different aspects of improving the system that suit the requirements in diverse cultures and ethnicities.


Dr. Diana Bruns who is a senior faculty member/research expert working in the University of Missouri USA spoke on educational qualities and police performance besides domestic violence against women. She informed that her study has revealed that out of 15000 Police deptts in US only 285 are headed by women Police officers.


Dr. Diana Bruns also shed light on the crimes against women and impact of college education on police performance. She backed her arguments on the data of her research on these subjects.


Prof. Mehraj-u-Din Vice Chancellor of Central University of Kashmir while speaking on the occasion said that in his view the deliverance in criminal justice system can be made more productive by focusing on speedy, fair and transparent investigations and trials. He said that the quantum of punishments cannot be as important as the speedy disposal of cases. He added that coordination between the elements of criminal justice system i.e Legislature, Executive and Judiciary is highly needed to achieve the desired results.


Mohammad Shafi Khan, Principal District and sessions Judge Srinagar in his presentation said that the criminal justice system is constantly evolving to better deliverance with each passing day. He said that the system that we inherited from the British is being constantly improvised by the Legislature and the Supreme Court to provide better delivery of justice to the people of the country. He asserted that judiciary and executive are prime requisites that need to be worked on, in order to give a better delivery of criminal justice system to the future generations.


DIG, CKR S A Mujtaba enunciated the approach adopted by the Jammu and Kashmir Police in the cases of domestic violence. He said that we have established a police station specifically meant for the cases of domestic violence. He said that in the cases of martial discord where violence is not present the police tries to negotiate a settlement between the wife and husband so that they carry on with their relationship in future as well.


He further stated that the cases of domestic violence are investigated and charge-sheeted as per the laws and procedures laid by the book. While referring to the civil liabilities, the DIG said that structure of the Police organization in the last two decades went under a change and had to adopt an approach of force multiplier. He said that law is easily enforceable, when more and more people are on the side of law. He thanked the experts and the guests for their participation and the police officers for their lively interaction.
