Sweeper Found Dead

SRINAGAR: A 56-year-old man who was working as a sweeper at Tehsil office Beerwah was found dead in Nallah Sukhnag at Beerwah in central Kashmir’s Budgam district on Thursday.

Quoting an official the news agency KNO reported that today morning a group of people found the body and accordingly informed the police. He said that the body was later shifted to sub-district hospital Beerwah.

He identified the deceased as Abdul Rahman Bhat son of Ghulam Qadir, resident of Beerwah, adding that investigation into the matter has been started.

Kargil Politicians Demand Restoration Of 370, Statehood For Ladakh At Meeting With Centre

SRINAGAR: A delegation of leaders from Kargil on Thursday attended a meeting hosted by Union Minister of State for Home Affairs G. Kishan Reddy during which they demanded the restoration of special status and the power to decide on permanent residents as well full statehood for Ladakh.

“We had 2 clear agendas — the restoration of Article 370 and 35A and full-fledged statehood for Ladakh. We discussed these with the Union Home Ministry for two and a half hours. More meetings are to be followed to discuss this,” reports quoted Asgar Ali Karbalai, leader of Congress and Kargil Democratic Alliance (KDA) as having said,

“Our agenda focused on the restoration of Article 370 and 35A. We also told that we were against division but were in favour of the State. We don’t consider Union Territory. We also discussed development,” newspaper The Hindu quoted Qamar Ali Akhoon, a leader of Jammu and Kashmir National Conference and the KDA as having said.

Why Suicide Is Not A Solution To A Temporary Problem?

Suicide is damaging the body to put an end to mental pain that is like putting a band-aid on your fingers hoping it will make your headache go away.

Life is really beautiful only if you start comparing yourself with anyone, listening to society because you know what? Society will tell you to live and then society will put pressure on you and tell you to die.

Stay alive for yourself, for your love, for your family, for your dream. All the other things never really mattered, the only thing that matters is that you are alive!

The problems you face the first time appear very severe but time and changes in circumstances make these bigger problems much smaller. So we have to adopt the formula of wait and see rather than killing oneself, for by ending one’s life.

Hermann Hess, a famous German poet and novelist experienced great turmoil and conflict with his parents. At the age of 15, he attempted suicide but was saved. After a long struggle, he became a great writer and in 1946 was awarded the noble prize in literature. He was lucky because he was saved but all aren’t.

Cause of Suicide

 Suicide is an extreme form of depression. The reason for the depression could be anything ranging from disappointment in so-called true love, business or academics to anything else as well – Bad grades, loss in business and failure are just mistakes.

Learn from them and move on. Sooner or later you will succeed. And what if someone who you love doesn’t love you back? Don’t bother thinking about it that simply means they have bad taste.

Allah is saving you from them and saving you for someone really special! Similarly, if you failed any examination you don’t have to worry, Allah must have made a better arrangement for you.

‘What About Me’

Let people think about what they think of you, the matter is what you think of yourself. Remember you were not born to impress society. You were born for your loved ones, for your dreams and above all for yourself. Your mother did not give birth to you for the people after nine months of hardship.

The present-day society will respect you and your thoughts only if you are holding a good post, have a job, have a big car or have the money earned by your parents.

Dear friends, it is the society that questions your ability and intelligence when you fail to get selected in any SSRB or UPSC examination. Instead of consoling you, they question your intelligence and ability.

Suicide Is No Option

Suicide is not an option. It is always completely out of question. It is a spiritual crime and it is the worst thing you can do to yourself. In the Quran Allah says “innama al usri yusra”  .. “indeed with every difficulty come ease” and “do not kill yourselves; indeed Allah is to you ever merciful” (Q:4:29)

Sabit bin al Dahak narrated that Prophet (saw) said,  whosoever kills himself with anything in this world will be tortured with it on the day of judgment”.  Abu Hurairah (ra) narrated that Prophet (saw) said, “Whoever throws himself down from the mountain and kills himself will be in the fire of hell, throwing himself down therein forever and ever.”

People resort to suicide to get relief from pain. They forget that relief is a feeling and they need to be alive to feel it. Suicide is damaging the body to put an end to mental pain that is like putting a band-aid on your fingers hoping it will make your headache go away.

How To Avoid Suicide

The best ways to avoid suicidal thoughts are:

Trust Yourself: Ups and downs are part of life and they are the means to prove your worth and they provide you with an opportunity to become a role model. Quitting is not an option. Facing the problems with an open heart is real bravery than uploading the video before taking the suicidal step.

Trust Allah and don’t forget “wala soufy uteek rabuk fatarda”….. “and your lord is going to give you and you will be satisfied” increase your ability to bear the pain and to increase your resource base. One of the simplest ways to increase all these is learning and meditation and doing some sort of social work. Meditation will help you quickly snap out of it.

Death is the ultimate adventure. But like all good things, you should have to wait for it to happen; otherwise, it becomes a tragedy and calamity.

ACB Chargesheets Forest Guard With Alleged Disproportionate Assets Worth Crores

SRINAGAR: The Jammu and Kashmir Anti Corruption Bureau has charge-sheeted a Forest Guard alleging that he has amassed assets worth crores along by indulging in “corrupt” and “illegal” activities.

As per the charge-sheet, Kewal Krishan Sharma, the accused, has acquired residential houses and residential flat outside union territory worth over crore of rupees.

“Besides this, the accused has also purchased a number of luxury vehicles viz Mahindra XUV-500, Thar Jeep, Scorpio, Mahindra Rexton, TATA Safari, and commercial Volvo bus, Matador, two JCB’s and two Tractors etc. in the name of his family members and close relatives. The accused has also incurred huge expenses on the education of his children, foreign tours and on maintaining lavish lifestyle,” the charge-sheet reads.

“During the investigation, it has been established that the accused Kewal Krishan Sharma who was a Forest Guard has in connivance with other accused persons acquired moveable and immovable assets as well as benami assets in the name of his close friends and relatives which are disproportionate to known sources of income of the accused persons,” the charge-sheet states further.

Along with Sharma, his wife Raj Kumari alias Baby Koul; his son Ishant Sharma and Babu Ram Sharma have been charge-sheeted for possessing assets disproportionate to his known sources of income which stand in his name and the name of his close friends & relatives as benami properties.

Early Elections Imperative To Remove Governance Deficit In JK: Altaf Bukhari

SRINAGAR: Apni Party President Syed Mohammad Altaf Bukhari on Thursday expressed serious concern over the governance deficit that has hugely impacted public delivery institutions in Jammu and Kashmir.

Addressing a day-long provincial level at Party headquarters in Srinagar, Bukhari said the void between the people and the government institutions is increasing exponentially in absence of an elected government.

He said that the people across Jammu and Kashmir are suffering immensely and unfortunately most of the officers and officials seem to be unwilling to listen to their woes and not to talk of mitigating their miseries.

“People are being pushed from pillar to post while their pressing issues go unnoticed. There is mounting resentment and alienation among the people that need to be addressed. And the only panacea to end their sufferings at the grassroots level is to give them a representative form of the government,” he pleaded.

He urged the government of India to carry out the delimitation process on a fast-track basis and in a time-bound manner in order to facilitate assembly elections at the earliest in Jammu and Kashmir.

Stressing on measures that will strengthen the party at the grassroots level, Bukhari impressed on the party leadership to mobilize their cadres in order to reach out to the people in their respective areas.

“It’s not that we have not achieved anything even without being in power. But much more is needed to be done to fulfill our commitments made with the people,” he said, adding that Apni Party’s rank and file should work together to disseminate the party’s socio-political and economic agenda among the people across the length and breadth of Jammu and Kashmir.

Various party senior leaders including district presidents, coordinators, youth leaders, DDC & ULB members presented their feedback and put forth their opinions on organizational matters during the meeting, the statement reads.

Proud Of Kashmiri Politicians Who Spoke In All-Party Meet: Sajad Lone

SRINAGAR: Peoples Conferences Chairman Sajad Gani Lone Thursday said he is proud of all the Kashmiri politicians who were part of the all-party meeting for their role in highlighting the pain of the people of the Valley.

Addressing a press conference here, Lone said, “In my view, there are no winners and losers in the all-party meeting. No one had gone to speak against Kashmir.”

He said everybody made Kashmir proud. “I give everyone equal marks. Rabble rousing and rhetorical statements won’t help in making New Delhi deliver.”

He said there is propriety involved in the meeting and even the Prime Minister just put out three tweets on the issue.

“It is only us who have diarrhea of speaking. Someone asked the sixth person present in the meeting about what I spoke but didn’t call me,” Lone said, adding that whatever is being written now is part of history.

“Forty years from now people should read the truth.”

He said that we won’t talk on Muzzafar Baig’s sacking as the matter is over for them “Whatever had to be spoken has been said by Imran (Ansari) Sahib.”

He said that statehood should be given back immediately as a matter of right. “I don’t link statehood with elections but I will fight them if everyone else does.”

He said opposition members talking about a boycott might be laying a trap.

He said his party believes in creating an environment in which New Delhi will deliver. “People in the past three years have been suffering.”

High Court Stays Fresh Appointment Of Law Officers Except Advocate General

SRINAGAR: The Jammu and Kashmir High Court stayed the appointment of Law Officers other than the Advocate General in a plea challenging the continued existence of the notification issued by the Department of Law, Justice and Parliamentary Affairs, inviting applications for engagement as Standing Counsel, reported LiveLaw.in.

According to report published by LiveLaw.in, a single-judge bench consisting of Justice Sanjeev Kumar ordered a writ as a Public Interest Litigation application suo moto, as it raised issues of seminal importance.

The petitioner challenged an advertisement issued in pursuance to the Jammu and Kashmir Law Officers to appoint law officers in the exercise of powers conferred by Section 124 of the Constitution of Jammu and Kashmir read with Section 492 of J&K Cr. P. C. The petitioner argues that after the promulgation of the J&K Reorganization Act, 2019, the Constitution of Jammu and Kashmir and State Criminal Procedure Code have been repealed and have ceased to be in existence, said the report.

The petition also challenges the eligibility criteria as given under the notification, allotting 02 marks for PG Diploma, 03 marks for Post Graduation and 05 marks for Ph. D. in Law for the required education qualification. The petitioner says that the said scheme is without any rationale and, therefore, per se arbitrary. The petition notes that allotting a weightage of 50 marks earmarked for Number of institutions in last two years of civil suits or defending civil suits is highly excessive without laying down any yardstick for assessment and allocation of 50 marks, it said.

The State argued that the Rules of 2016 are saved by the J&K Reorganization Act, 2019 and, therefore, can validly regulate the appointment and conditions of service of Law Officers in Jammu and Kashmir.

For the issue relating to the selection criteria, the state-respondent argued that the Government is well within its right to devise any selection criteria for selection and appointment of Law officers, and the same cannot be interfered with unless it is totally arbitrary, irrational and is found to have no nexus with the object sought to be achieved.

“Allocation of 50 marks, i.e., 02 marks for each institution of a civil suit or defending civil suit in last two years, it is submitted, cannot be termed as arbitrary or irrational because its definite object to be achieved is the selection of competent Law Officers to plead for or defend the Government in District Courts,” the State argued, according to LiveLaw.in.

It also argued that the mark distribution between LLB Qualification (10), relevant PG Diploma (02), Post Graduation in Law (03) and Ph.D. in law (05) is only in recognition with merit and gives a slight edge to the candidates possessing higher qualification and, therefore, the same too cannot be termed as arbitrary.

The Court held that the Rules of 2016 are deficient in complying with the statutory provisions of Section 24 of the Code of Civil Procedure, 1973 and not in conformity with the law laid down by the Supreme Court in the case of State Punjab & Anr. v. Brijeshwar Singh Chahal and Anr (2016) 6 SCC 1, where the SC held that the States should “reform their system of selection and appointment to make the same more transparent, fair and objective if necessary by amending the relevant LR Manuals/Rules and Regulations on the subject.”

The Brijeshwar Singh Chahal case also noted that the power to engage, employ and recruit must be exercised in a “fair, reasonable, non-discriminatory and objective manner,” An arbitrary action is offensive to Article 14 of the Constitution. As the appointment of a government counsel at both district and High Court levels is not just a professional engagement but has a ‘public element’ attached to it, the appointment must be only in the public interest, unaffected by any political or other extraneous considerations, the Court held.

The Court held that the Rules of 2016 framed by the then State of Jammu and Kashmir are deemed to be in operation in the Union Territory of Jammu and Kashmir to provide for eligibility requirements for the appointment of Law Officers, although not following the directives and the guidelines laid down by the Supreme Court in Brijeshwar Singh Chahal’s case.

The Court held that the petitioner in representative capacity had raised issues that have to be consulted by the High Court or not need determination by an authoritative pronouncement by a larger Bench.

‘The impugned selection criteria laid down in the advertisement notice itself though within the respondents’ discretion and, prima facie, not found bad yet would pose practical difficulties in its application. There are no specific guidelines for assessing a candidate’s working experience. Fifty points earmarked for institutions are capable of being misused in the absence of proper yardstick”, the Court observed, according to report.

On the issue of giving weightage to the number of institutions of a civil suit in the last two years, the Court held that it is not clear as to whether the filing of civil suit/proceedings must be by the candidate as an independent counsel or it could be in his capacity of a junior to a senior advocate. It observed that an advocate having independent practice might have fewer institutions than a candidate working with some noted senior advocate.

Similarly, the Court found the issue of allocation of 10 marks to qualification higher than LL.B as “apparently irrational and does not seem to have any nexus with the job.” The Court posed a question that when the Chief Justice of India and the Judges of Supreme Court and High Courts can be appointed with LLB qualification only, then why can’t a candidate with the same qualification be a competent Law Officer.

The Court held that this matter is important, and it should be imperative that these engagements are merit-based. “The quality of assistance rendered to the Court has a direct impact on the quality of justice delivered. It is, therefore, of essence that the advocates who represent State/UT in civil as well as criminal matters are of sterling quality. Poor assistance from either side, particularly from the Government side, which is the biggest litigant in courts, affects the administration of justice.”

The Court directed to treat the PIL suo moto and concluded that the policy of engagement of Government lawyers at all levels deserves a fresh look, and it is imperative that these engagements are merit-based and do not fall foul of Article 14 of the Constitution Of India.

The Court posted the matter before the Chief Justice for listing before the appropriate Bench and directed that till the matter is pending, no fresh appointment of Law Officers be made other than the Advocate General, reported LiveLaw.in.
