SRINAGAR: The Baramulla special magistrate court has sentenced a man to two years in prison and ordered him to pay a fine of Rs 16 lakh, which is double the amount of the bounced cheque.
In an order, Judge Iqbal Ahmad Akhoon found Ameer Ahmad Khan of Boniyar, Baramulla, guilty of violating Section 138 of the Negotiable Instrument Act and sentenced him to two years in prison.
The court also directed Khan to pay Rs 16 lakh as compensation to complainant Abdul Lateef Khan.
In the order, Judge Akhoon stated that the complainant had successfully demonstrated that the cheques issued to him were returned by the bank due to insufficient funds in Khan’s account.
“The complainant has proven during the trial that the accused had a legally enforceable debt for which he issued the aforementioned cheques. These cheques were presented to the bank but were returned unpaid due to a lack of sufficient funds in the accused’s account,” the court noted.
The Judge further emphasised that the accused failed to provide evidence that he had not received the notice. Mohammad Rafiq and associates represented the complainant. (KNO)
