Bandipora Court Convicts 6 Timber Smugglers

SRINAGAR: The court of Judicial Magistrate Towfeel Ahmad Mir convicted accused persons in the forest Act Case in Bandipora.

The Charge sheet in the case FIR number 155/2011 of P/S Bandipora was presented before the Court on 03/12/2011. The accused persons who were 06 were charged for the commission of an offence punishable U/S 379 RPC, 6 F.Act, reads the handout issued by Dy Director prosecution Bandipora.

“The brief facts of the case are that on 09-07-2011 Police Station Bandipora received a written complaint from the officials of Forest Department that they were on patrolling duty at Kandi Compartment they found accused persons have cut down three poles measuring 30*40(01), 40*50(02) in Compartment No 38 and were taking the same which came to be seized from them, they accused persons were chased but fled away and one among them Bilal Ahmad Dar was apprehended on spot,” it reads.

“The rest of the accused persons came to be arrested during the course of the investigation and which culminated into a charge sheet. The Court on the basis of evidence recorded, arguments from Prosecution and Defense finally convicted all the accused persons for the commission of an offence punishable U/s 379 RPC read with 6 Forest Act,” it added.

The Court awarded 06 months imprisonment to all the accused persons for the offence 379 RPC and 03 Months imprisonment for 6 Forest Act, a fine of 1000 each was also imposed upon all and in default of which they shall undergo simple imprisonment of 15 days.

The accused persons identified as Bilal Ahmad Dar, Hameed Lasoo, Ayoub Darzi, Farooq Ahmad Kawa, Imtiyaz Ahmad Kharoo and Javid Ahmad Darzi have been taken into custody and lodged in District Jail Kupwara.

The Assistant  Public Prosecutor JMIC Court  Bandipora Bilal Ahmad Khan pleaded the matter on behalf of UT of J&K while as accused persons were represented by Adv Malik Mushtaq and Adv Reyaz Ahmad, reads the statement issued from the office of the Deputy Director of Prosecution Ganderbal and Bandipora.
