SRINAGAR: In a recent ruling, the High Court of Jammu & Kashmir and Ladakh at Srinagar has dismissed the petition filed by Noor Ahmad Shah, seeking inclusion in the Swantantrata Sainik Samman Pension Scheme of the Government of India. The order, issued by Justice Sanjay Dhar, determined that the petitioner did not meet the eligibility criteria for the pension scheme.
Shah sought recognition as a freedom fighter in accordance with the pension scheme. He argued that he had provided commendable services to the government while individually combating various militants. He cited receiving an appreciation certificate from the Indian Army operating in the Kupwara district as evidence of his contributions.
However, the respondent-authorities countered Shah’s claim, asserting that only individuals who actively participated in the freedom movement and met the eligibility criteria specified in the Swantantrata Sainik Samman Yojna were eligible for benefits under the SSSP scheme.
In agreement with the government’s position, the High Court determined that the petitioner’s claim lacked merit and subsequently dismissed the plea.
The judgment, delivered on August 4, 2023, marks the conclusion of this legal dispute, with Shah’s request for inclusion in the pension scheme denied by the High Court.
Advocate IA Sofi represented the petitioner, while Deputy Solicitor General Tahir Majeed Shamsi appeared on behalf of the respondent-authorities.
