After assurances of ‘murder charges’ against army, slain youth being laid to rest

Soon after the district administration assured the protesting civilians that an FIR under section 302 CrPc would be filed against army for killing a civilian, Shahid Ahmad Mir, in a fake encounter, the locals of Tarathpora in Handwara on Thursday offered the funeral prayers of the slain and have agreed to bury him.

Local sources, privy to the meeting between the district administration and the elders of the locality, informed Kashmir Life that the administration after an hour long meeting has agreed to file an FIR against army under section 302 CrPc. Besides, they said, the DC handed over a copy of No Objection Certificate to the family. The NOC mentions that the slain was a civilian and had no links whatsoever with militancy.

As soon as the meeting ended, the local offered the funeral prayers and are finalising the last rites of slain Shahid, locals said.

Meanwhile, a number of protesters have suffered injuries during clashes with police and other forces. Locals said that police used tear smoke shells and pellets to disperse the protesters. During the clashes three have suffered pellet injuries including a girl, they said.

Section 302 CRPC

Permission to conduct the prosecution.

(1) Any Magistrate inquiring into or trying a case may permit the prosecution to be conducted by any person other than a police officer below the rank of Inspector; but no person, other than the Advocate General or Government Advocate or a Public Prosecutor or Assistant Public Prosecutor, shall be entitled to do so without such permission: Provided that no police officer shall be permitted to conduct the prosecution if he has taken part in the investigation into the offence with respect to which the accused is being prosecuted.

(2) Any person conducting the prosecution may do so personally or by a pleader.
